Injunction Dissolved
"With the general receding of the COVID-19 crises and the availability of COVID-19 vaccines among the homeless population in the Benchlands, the Court finds that there no longer is the state created danger that the Court previously found arising out of the City’s eviction order during what appeared to be the peak of the COVID-19 pandemic. Further, Plaintiffs acknowledge and the City affirms that there are no immediate plans to evict residents from the Benchlands. Taking all of these factors together, there is no threat of imminent, irreparable harm and the balance of hardships now tips in favor of Defendants. Accordingly, the Court DISSOLVES the preliminary injunction, effective at midnight on June 30, 2021. Parties have 14 days from the date of this Order to file a stipulation or motion regarding dismissal." -SO ORDERED. Dated: June 29, 2021
